A. Terms of Business for individual customers

A1. These are the terms and conditions of an agreement between our company (Kabushikigaisha The English Company of 2-8 Nakajuku, Itabashi-ku, Tokyo, 173-0005, Japan) and you the customer (being any individual or organization that orders products from us). If you order products from us, it signals that you accept and will abide by our terms of business. (This does not affect your statutory rights.)

A2. The pricing of our products is listed on the pages of our online Retail Store. Individuals who wish to order a large quantity of our products may be eligible to receive a discount and should contact us to discuss pricing. While using the Store you may choose to display the price of products in your local currency but the base currency for the price of our products is Japanese Yen. The pricing of our products in other currencies may fluctuate as exchange rates change.

A3. The money payable for all orders including shipping must be paid for in full and in advance.

A4. When you submit your order, we will issue an order confirmation and when your order has been paid for and dispatched we will issue a shipping notification.

A5. Use of our online service, The Study Centre, by end users is for one calendar year. This may be extended upon application by the end user.

A6. All sales are final and may not be returned except in the case of the product being defective. See item A7 (below).

A7. In the case of product that is found to be defective and if the damage has not been caused by the end user, it will be replaced free of charge including shipping costs. Determination of whether a product is defective due to the actions of the end user will be made exclusively by us. Customers must contact us before returning any product.

A8. Product that has been lost or damaged by the end user may be replaced by ordering a replacement.

A9. Bank charges incurred by a customer when paying an invoice are the responsibility of the customer.

A10. The customer is solely responsible for the accuracy of the information submitted on the website or on order forms. We will not be responsible for product that is lost or for delayed delivery due to missing, incomplete or incorrect information submitted on the website or on order forms.

11. We will endeavour to dispatch orders promptly and meet the estimated delivery date, but will not be liable for any delay in products reaching you by the date you have specified if the delay is due to any factor outside of our control.

 

B. Terms of Business for wholesale customers in Japan

B1. These are the terms and conditions of an agreement between our company (Kabushikigaisha The English Company of 2-8 Nakajuku, Itabashi-ku, Tokyo, 173-0005, Japan) and you the customer (being any individual or organization that orders products from us). If you order products from us, it signals that you accept and will abide by our terms of business. (This does not affect your statutory rights.)

B2. The pricing of our products for wholesalers and/or schools is listed on the pages of our online Wholesale Store. Pricing is discounted for wholesalers and/or educational institutions.

B3. Payment for orders may be made on account unless this facility has been withdrawn if there have been irregularities with payments on previous orders. See item B12 (below).

B4. When you have submitted your order, we will contact you by email and inform you or our bank details and shipping charges. We may choose to waive shipping charges to customers whose accounts are in good standing.

B5. Use of our online service, The Study Centre, by end users is for one calendar year. This may be extended upon application by the end user.

B6. Wholesale customers may return up to twenty per cent of the total amount of product ordered provided that the returned product is wholly unused and solely at the customer’s expense up to 60 days from the original date of dispatch. This returns percentage excludes any product that is found to be defective. See item B7 (below).

B9. Bank charges incurred by a customer when paying an invoice are the responsibility of the customer. Bank charges incurred by The English Company, when paying refunds resulting from a customer returning surplus product, will be deducted from the sum to be repaid to the customer.

B10. The customer is solely responsible for the accuracy of the information submitted on the website or on order forms. We will not be responsible for product that is lost or for delayed delivery due to missing, incomplete or incorrect information submitted on the website or on order forms.

B11. We will endeavour to dispatch orders promptly and meet the estimated delivery date, but will not be liable for any delay in products reaching you by the date you have requested if the delay is due to any factor outside of our control.

B12. Customers who are consistently late in making payments to clear the balance owing on their account may have their account suspended and/or be asked to pay in advance for further orders. Late payment surcharges to cover administration costs such as the sending of reminder notices may also be levied.

 

C. Terms of Business for wholesale customers outside Japan

C1. These are the terms and conditions of an agreement between our company (Kabushikigaisha The English Company of 2-8 Nakajuku, Itabashi-ku, Tokyo, 173-0005, Japan) and you the customer (being any individual or organization that orders products from us).
